I declare, confirm and agree as follows, that I/my Ward:

(i) In case of participation by a person aged below eighteen (18) years of age ("Ward"), represent and warrant that I am the legal guardian of the Ward and have the legal right to represent the Ward and grant such waiver and consent as is envisaged in this form ("Form") in my capacity as the legal guardian of the Ward.

(ii) Have provided information in this registration form (inclusive of this Form) that is true and complete, and I am solely responsible for the accuracy of this information.

(iii) Have fully understood the risk and responsibility of participating in the Guwahati International Marathon or any event outlined in this application (together, "the Event") and will be participating entirely at my/my Ward's risk and responsibility.

(iv) Shall only participate on the course designated by the Event organizer.

(v) Understand the risk of participating on a course with vehicular traffic, even if the course may be regulated/policed.

(vi) Understand that I/my Ward must be, and must train to, an appropriate level of fitness to participate in such a physically demanding event, and I/my Ward have/has obtained a medical clearance from a registered medical practitioner, allowing me/my Ward to participate in the Event.

(vii) For myself/my Ward and my/their legal representatives, waive all claims of whatsoever nature against any and all sponsors of the Event, all the Event committee persons, officials and volunteers, the Event promoters PMG Sports LLP ("Promoter"), and all other persons and entities associated with the Event and the directors, employees, agents and representatives of all or any of the aforementioned — including, but not limited to, any claims that might result from me participating in the Event, whether on account of illness, injury, death or otherwise, including those arising from overexertion, medical conditions, fatigue and/or dehydration, accidents or incidents involving other participants, and weather conditions, fractures, muscle tear or ligament damage.

(viii) If I/my Ward am/is injured or taken ill or otherwise suffer any detriment whatsoever, I hereby irrevocably authorize the Event officials and organizers to, at my risk and cost, transport me to a medical facility and/or administer emergency medical treatment — including administration of anaesthesia — as they may consider necessary in such circumstances, and I waive all claims that might result from such transport and/or treatment or delay or deficiency therein. I shall pay or reimburse to you my/my Ward's medical and emergency expenses, and I hereby authorize you to incur the same.

(ix) Shall provide to the Promoter, Event organizers and officials such medical data relating to me/my Ward as they may request. I agree that nothing herein shall oblige the Promoter, Event officials, organizers, or any other person to incur any expense or to provide any transport or treatment.

(x) In case of any illness, transmittable/communicable/contagious disease or injury caused to me/my Ward, or death suffered by me/my Ward during the Event due to any force majeure event — including but not limited to fire, riots or other civil disturbances, earthquakes, storms, flood, typhoons, or any terrorist act — none of the sponsors of the Event, any political entity or authorities and officials, any contractor or construction firms working on or near the course, any of the Event committee persons, officials or volunteers, the Promoter, or any persons or entities associated with the Event, or the directors, employees, agents or representatives of all or any of the aforementioned, shall be held liable by me or my representatives.

(xi) Understand, agree and irrevocably permit the Promoter to collect, process, store, and share my/my Ward's personal information given by me in this application with all/any entities associated with the Event, at its own discretion.

(xii) Understand, agree and irrevocably permit and grant to the Promoter a royalty-free, sub-licensable right and license (in perpetuity and on a worldwide basis) to use my/my Ward's Attributes for the purpose of promoting the Event, anywhere in the world, in any medium — physical, broadcast or digital (including the internet and social media) — or any other media which may become known in the future, at its own discretion. Further, I, on behalf of the Ward, waive all moral rights and personality rights, including any right to have my/the Ward's name affixed to each usage of my/the Ward's image, under applicable law, to the extent permissible, in respect of the aforesaid license grant.

"Attributes" shall mean my/my Ward's: (a) name, image, reputation, nickname, voice, fame and other characteristics or personal attributes of any kind; and/or (b) pictures, photographs, video recording, audio recording and any other portrayal of any kind arising out of my/the Ward's involvement and/or participation in the Event.

(xiii) Shall not hold the organizers and all/any of the Event sponsors or Promoter responsible for loss of my/my Ward's registration form and/or registration fee in transit.

(xiv) I understand and agree that the Promoter shall be under no obligation to refund any registration fees in case of an occurrence of a force majeure event which results in cancellation of the Event.

(xv) I/my Ward agree to receive information and offers of various brands/products/services as may be sent to me by the Event Promoter (or a person duly authorized by the Promoter) on the email address given by me/my Ward in this registration form.

(xvi) Attest and confirm that I/my Ward shall not participate in the Event in case I/my Ward:     (a) suffer(s) from any illness or injury that could interfere with my/their safe participation in the Event;     (b) suffer(s) from any cardiovascular conditions or such other serious health conditions;     (c) have/has contracted any contagious diseases within the last three (3) weeks prior to the Event; or     (d) am under the influence of alcohol or any narcotic or psychotropic substances at the time of participation in the Event.

(xvii) For the duration of the Event, I/my Ward will conduct myself/themselves and act responsibly in accordance with all lawful and reasonable instructions of Event organizers and/or Promoter, and abide by all such applicable policies and regulations in respect of the Event.

(xviii) Agree and understand that the Event organizer and/or Promoter reserves the right to decline or disallow participation or further participation in the Event at any time, should the Promoter/Event organizer reasonably believe that my/my Ward's involvement in the Event is likely to cause injury or harm, is likely to be detrimental to the rights or welfare of any other participants, or that my/my Ward's actions or general behaviour impede the operation of the Event. Similarly, if my/my Ward's conduct violates any policy or procedure of the Event or this Form, I understand that I/my Ward may be required to leave the Event at the sole discretion of the Event organizer and/or Promoter. I understand and agree that I/my Ward shall not be entitled to any refund or return of the registration fees, or otherwise entitled to claim any damages or expenses from the Event organizer and/or Promoter or its agents/service providers, in case I/my Ward is declined or disallowed involvement or participation in the Event as aforesaid.

(xix) To the extent permitted by applicable law, I/my Ward and my/his/her respective heirs, representatives, assigns and successors release and discharge the Promoter, the Event organizer, and their respective directors, officers, employees, personnel, agents and representatives against any and all claims of any nature whatsoever arising against them with respect to any and all injury, illness, disability, death, loss or damage suffered by me/my Ward that might result from my/my Ward's participation in the Event and allied activities thereby.

(xx) I understand and agree to the Event Terms and Guidelines.
